As from this date, when an applicant claims a priority at the time of the filing of a European patent application, he has to file a copy of the results of any search carried out by the Office of first filing:
- together with the filing of the European patent application, or
- in the case of a Euro-PCT application, on entry into the European phase.
The applicant is exempted from this obligation if he claims the priority of:
- a European application or PCT application for which the EPO has carried out the prior art search;
- a national application for which the EPO has made the official search (application filed in Belgium, Cyprus, France, Greece, Italy, Luxembourg, Malta, Netherlands or Turkey);
- a first filing made in Japan, the United Kingdom or the United States of America.
